These Terms of Service ("Terms") govern your use of the LPlate platform and services. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully before using our platform.
1. Service Description
LPlate is an online platform that connects driving students with qualified Approved Driving Instructors (ADI) in the United Kingdom. Our service facilitates:
- Searching and booking driving lessons
- Instructor profile management and availability scheduling
- Secure payment processing
- Lesson tracking and progress monitoring
- Communication tools between students and instructors
- Review and rating systems
2. Eligibility and Account Registration
2.1 General Eligibility
To use our services, you must:
- Be at least 16 years old (or have parental consent if under 18)
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Comply with all applicable laws and regulations
2.2 Instructor Requirements
To provide services as an instructor, you must:
- Hold a valid ADI licence issued by the DVSA
- Have appropriate vehicle insurance covering driving instruction
- Maintain all required professional qualifications
- Comply with DVSA standards and regulations
3. User Responsibilities
3.1 General Conduct
All users must:
- Use the platform in good faith and for lawful purposes
- Provide accurate information and keep it updated
- Respect other users and maintain professional conduct
- Not engage in fraudulent, abusive, or harmful behaviour
- Comply with our Community Guidelines
3.2 Student Responsibilities
- Arrive punctually for scheduled lessons
- Follow instructor safety guidelines
- Provide accurate pickup locations and contact information
- Cancel lessons with appropriate notice as per our cancellation policy
3.3 Instructor Responsibilities
- Maintain professional standards at all times
- Ensure vehicle safety and appropriate insurance coverage
- Keep availability calendar updated
- Provide quality driving instruction in accordance with DVSA standards
- Handle student data in compliance with our Privacy Policy
4. Booking and Payment Terms
4.1 Booking Process
- Students can search and book available lesson slots
- Bookings are confirmed when payment is successfully processed
- Lesson details and instructor contact information are provided upon confirmation
- Both parties receive booking confirmation via email/SMS
4.2 Payment Processing
- All payments are processed securely through Stripe Connect
- Students pay the full lesson fee at the time of booking
- LPlate retains a service fee, with the remainder paid to instructors
- Payment schedules for instructors are detailed in the Instructor Terms
4.3 Pricing
- Lesson prices are set by individual instructors
- All prices are displayed clearly before booking
- Additional fees (if any) will be clearly disclosed
- Prices may vary based on lesson type, duration, and location
5. Cancellation and Refund Policy
5.1 Student Cancellations
- 24+ hours notice: Full refund
- 2-24 hours notice: 50% refund
- Less than 2 hours: No refund (except emergency circumstances)
- No show: No refund
5.2 Instructor Cancellations
- Full refund provided for any instructor-initiated cancellation
- We will attempt to arrange alternative lessons where possible
- Compensation may be provided for short-notice cancellations
5.3 Weather and Emergency Cancellations
Lessons may be cancelled due to dangerous weather conditions or emergencies. Full refunds or rescheduling will be offered in such circumstances.
6. Platform Fees and Instructor Payments
6.1 Service Fees
- LPlate charges a service fee on each completed lesson
- Current fee structure is detailed in the Instructor Terms
- Fees may be updated with 30 days' notice to instructors
6.2 Payment Schedule
- Instructor payments are processed at 12pm every Monday
- Payments are made via bank transfer to registered accounts
- Detailed payment statements are provided monthly
- Minimum payout threshold: £10
7. Liability and Insurance
7.1 Platform Limitations
LPlate acts as an intermediary platform connecting students and instructors. We do not:
- Directly provide driving instruction services
- Control the quality or conduct of lessons
- Assume liability for instructor or student actions
- Guarantee lesson outcomes or test results
7.2 Limitation of Liability
To the maximum extent permitted by law, LPlate's liability is limited to the amount paid for the specific service in question. We exclude liability for:
- Indirect, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Actions or omissions of instructors or students
- Technical issues or service interruptions
7.3 Insurance Requirements
Instructors must maintain appropriate insurance coverage for driving instruction. Students are advised to check their own insurance coverage for driving lessons.
8. Intellectual Property
The LPlate platform, including its design, functionality, and content, is protected by intellectual property rights. Users may not:
- Copy, reproduce, or distribute platform content
- Reverse engineer or attempt to extract source code
- Use our trademarks or branding without permission
- Create derivative works based on our platform
9. Data Protection and Privacy
Your privacy is important to us. Our collection, use, and protection of personal data is governed by our Privacy Policy, which forms part of these Terms.
10. Dispute Resolution
10.1 Internal Resolution
We encourage users to first attempt to resolve disputes directly. If unsuccessful, our support team can provide mediation assistance.
10.2 Formal Complaints
Formal complaints should be submitted to Staff@LPlateApp.comand will be investigated within 14 days.
10.3 Legal Proceedings
Any legal disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, and governed by English law.
11. Service Availability and Modifications
11.1 Service Availability
- We aim to provide 24/7 platform availability
- Scheduled maintenance will be communicated in advance
- Emergency maintenance may cause temporary service interruptions
11.2 Service Modifications
We reserve the right to modify, suspend, or discontinue services with reasonable notice. Material changes affecting user rights will be communicated at least 30 days in advance.
12. Account Termination
12.1 User Termination
- Users may close their accounts at any time
- Outstanding bookings must be completed or cancelled
- Data deletion requests can be made via our Privacy Policy procedures
12.2 Platform Termination
We may terminate accounts for:
- Breach of these Terms or Community Guidelines
- Fraudulent or illegal activity
- Failure to maintain required qualifications (instructors)
- Consistently poor reviews or conduct
13. Governing Law and Jurisdiction
These Terms are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales. The Consumer Rights Act 2015 and other applicable UK consumer protection laws remain in full effect.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of our services after changes constitute acceptance of the updated Terms.
